Michael Shane Penka whose last known address was Darke County Sheriff office located 5185 County Home Rd, Greenville, OH 45331 and Chelsea Louise Lear whose last known address was 521 South Miami Street Sidney, Ohio 45365 and whose current place of residence and whereabouts cannot with reasonable diligence be ascertained, will take notice that on June 5, 2020 Darrel Matthew McBrayer, stepfather, filed his petition for adoption of Lillian Mackenzie Garrett Case No.2020ADP00057 and Tanner Braydon Garrett Case No. 2020ADP00058, and On June 5, 2020 Diana Michelle McBrayer, stepmother, filled her petition for adoption of Sophia Grace McBrayer Case No.2020ADP00059 in Probate Court, Montgomery County, Ohio, praying that he (Darrel Matthew McBrayer) be permitted by order of the Court, to adopt, as his own child, Lillian Mackenzie Garrett a minor born in Richmond, Indiana and Tanner Braydon Garrett a minor born in Greenville, Ohio and that she (Diana Michelle McBrayer) be permitted by order of the Court, to adopt, as her own child Sophia Grace McBrayer a minor who was born in Greenville, Ohio and that the name of the children be changed to Lillian Mackenzie McBrayer and Tanner Braydon McBrayer. There will be no change to Sophia Grace McBrayer's name. Alleging among other things that Michael Shane Penka natural father of (Lillian Mackenzie Garrett & Tanner Braydon Garrett) and Chelsea Louise Lear natural mother of (Sophia Grace McBrayer) has failed without justifiable cause, to provide more than de minimis contact with above minors or to provide for the maintenance and support of the minors listed above as required by law or judicial decree for a period of at least one (1) year preceding the filing of Adoption Petition(s). A final decree of adoption, if granted, will relieve you of all parental rights and responsibilities, including the right to contact the minor(s), and except with respect to a spouse of the adoption petitioner and relatives of that spouse, terminate all legal relationships between the minor and you and minor's other relatives. So that the minor thereafter is a stranger to you and the minor's former relatives for all purposes. If you wish to contest the adoption, you must file an objection to the petition within fourteen days after proof of service of the notice of the filing of the petition and the time and place of hearing is given to you. If you wish to contest the adoption you must appear at the hearing. A final decree of adoption may be entered if you fail to file an objection to the adoption petition or appear at the hearing. The petitions will be heard for determination by the Honorable Judge Alice O. McCollum of the Probate Court of Montgomery County, Ohio, 41 North Perry Street, Dayton, Ohio on the 16th day of October, 2020 at 9:30 AM and at 9:50 AM 7-31, 8-7, 8-14/2020
