NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS AND NOTICE OF FINDING OF NO SIGNIFICANT IMPACT September 8, 2020 Butler County, Ohio Department of Development Community Development Division 130 High Street, 6th Floor Hamilton, OH 45011 (513) 785-5391 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Butler County, Ohio. REQUEST FOR RELEASE OF FUNDS On or about September 24, 2020, the County of Butler will submit a request to the U.S. Department of Housing and Urban Development (HUD), Region V Office for the release of Community Development Block Grant (CDBG), Home Investment Partnerships Act (HOME) and Shelter Plus Care funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended, to undertake the following projects: City of Fairfield, Realignment of Rt. 4 and Michael Lane $125,672 (CDBG) City of Oxford, Sidewalk Ramp Improvements $125,672 (CDBG) Madison Township, Paving Aljen & Corlee Roads $52,000 (CDBG) St. Clair Township, South Street Paving $55,000 (CDBG) St. Clair Township, Williamsdale Various Roads Paving $145,000 (CDBG) Fairfield Township, Fairfax Avenue Storm Sewer $235,000 (CDBG) Ross Township, SR128, School Rd., Layhigh Sidewalks $146,000 (CDBG) Butler County Care Facility Elevator & Sprinkler $55,000 (CDBG) Butler County Emergency Home Repair $20,000 (CDBG) SELF, Volunteer Home Repair Initiative $30,000 (CDBG) NHS, Acquisition Rehab Homebuyer Project $175,000 (HOME) Continuum of Care, Shelter Plus Care $550,519 (CH) (ACH) (HIF) An Environmental Review Record (ERR) for the projects listed above has been conducted by the Butler County Department of Community Development. In it, the County has determined that, pursuant to 24 CFR Part 58.35, the above listed activities are Categorically Excluded from requirements of the National Environmental Policy Act of 1969 (PL 91-190). On or about September 24, 2020, the County of Butler will submit a request to the U.S. Department of Housing and Urban Development (HUD), Region V Office for the release of Community Development Block Grant (CDBG), Home Investment Partnerships Act (HOME) and Continuum of Care, Shelter Plus Care funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended, to undertake the following projects: Butler County Demo Program Countywide $39,260 (CDBG) PFH Disabled Housing 4-Unit Construction $150,000 (HOME) Habitat for Humanity, New Construction $50,000 (HOME) Affordable Safe Rental Housing, Permanent Supportive Units $475,000 (HOME) FINDING OF NO SIGNIFICANT IMPACT Butler County has determined that the projects will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Butler County Department of Development, Community Development Division, 130 High Street, 6th Floor, Hamilton, Ohio 45011 and may be examined or copied weekdays 7:30 A.M to 4:30 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Butler County Department of Development, Community Development Division, at 130 High Street, 6th Floor, Hamilton, OH 45011. All comments received by September 23, 2020 will be considered by Butler County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION Butler County certifies to HUD that Desmond J. Maaytah in his capacity as Butler County Community Development Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Butler County to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and Butler County's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Butler County; (b) Butler County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at Ohio State (Columbus) Office, Office of Community Planning and Development, 200 North High Street, Columbus, Ohio 43215-2499.
