Public Notice: 2019 Annual Assessment of Institutional Controls, Mound, Ohio, Site, in Miamisburg, Ohio The U.S. Department of Energy (DOE) Office of Legacy Management has completed the 2019 annual assessment of the effectiveness of institutional controls (ICs) at the Mound, Ohio, Site (former DOE Mound Plant, EPA ID: OH6890008984) in Miamisburg, Ohio. ICs are legally enforceable requirements defined in Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) records of decision (RODs) for specific areas within the original DOE Mound Plant property boundary. ICs are non-engineered instruments, such as administrative and legal controls, that help: (1) minimize the potential for human exposure to residual contamination, (2) protect the integrity of the environmental remedy, or (3) both. The Annual Assessment of the Effectiveness of Institutional Controls at the Mound, Ohio, Site, Miamisburg, Ohio, June 2019 (LMS/MND/S24339) report concluded that ICs implemented at the Mound site under CERCLA are functioning as intended and are protective of human health and the environment. Mound site ICs are designed to: 1. Prohibit removal of soil from within the original DOE Mound Plant property boundaries, unless prior written approval from the U.S. Environmental Protection Agency (EPA), Ohio EPA, and Ohio Department of Health (ODH) has been obtained. 2. Prohibit extraction, consumption, exposure to, or any use of groundwater underlying the premises, unless prior written approval from EPA and Ohio EPA has been obtained. 3. Limit land use to industrial or commercial use only. These ICs prohibit residential use, farming, and any activities that could result in the chronic exposure of children less than 18 years of age to soil or groundwater from the premises. 4. Prohibit removal or transfer of concrete floor material from specified rooms of the former Technical (T) Building to off-site locations without prior written approval from EPA, Ohio EPA, and ODH. 5. Prohibit penetration of concrete floors in specified rooms of the T Building without prior written approval from EPA, Ohio EPA, and ODH. 6.
