IN THE CHANCERY COURT FOR OVERTON COUNTY, TENNESSEE NO. 19-CV-56 ROY E. NISWONGER, Petitioner, vs. CHRIS PYLANT, PATRICK PYLANT, MICHAEL WILSON, DAVID MARQUETTE, KELLY HICKS, and MELISSA HOLT, Respondents. ORDER FOR SERVICE BY PUBLICATION This matter came on to be heard on the 28th day of October, 2019 before the Honorable Ronald Thurman, Chancellor, upon the Petitioner's Motion for Service by Publication pursuant to T.C.A. § 21-1-204. After consideration of statement of counsel, and the entire record in this cause, the Court hereby finds that service has been attempted at the last known addresses of Respondents, Chris Pylant, Patrick Pylant and Michael Wilson in Amarillo, Texas. Service has been returned that the Respondents are not at these addresses. Service has also been attempted upon Respondent, David Marquette, in New Carlisle, Ohio. The return affidavit reflects that the Respondent is not at the indicated address. Petitioner and Petitioner's counsel have been unable to obtain any better addresses for the Respondents who remain to be served. Wherefore, the Court hereby orders that the Respondents, Chris Pylant, Patrick Pylant, Michael Wilson, and David Marquette shall be served by publication. This order shall be published in a weekly publication in the county of their last known residence and the county of this action for four consecutive weeks. Failure to respond to this action within thirty (30) days of the last publication of such notice may result in default being taken with respect to such Respondents. The hearing date for such default shall be January 10, 2020, at the Putnam County Justice Center in Cookeville, Tennessee at 10:00 a.m. A copy of this order, along with a copy of the Complaint, shall also be forwarded by the Clerk and Master to each of the named Respondents herein at their last known address in accordance with T.C.A. §21-1-105.
