Defendants LEGAL NOTICE FOR SERVICE BY PUBLICATION To: Defendants, Richard Lee Steinway Jr and Unknown Spouse, if any, of Richard Lee Steinway Jr., name unknown, you will take notice that on the 11th day of November, 2019, Plaintiff, filed a Complaint for foreclosure in the Montgomery County Court of Common Pleas, 41 North Perry Street, Dayton, OH 45402-1431, being Case No. 2019 CV 05338, alleging that there is due to the Plaintiff on Tax Certificate No. 2016-0000000454, the principal amount of $3,258.20, plus interest at 18.00% from October 18, 2016, on Tax Certificate No. 2018-0000000187, the principal amount of $3,575.64, plus interest at 18.00% from February 27, 2018 and the amount paid to the County Treasurer for current taxes, interest, and charges not covered by the Tax Certificates in the principal amount of Taxes, assessments, penalties, interest and charges that are not covered by a tax certificate, Plaintiff is owed as of October 9, 2019, the principal amount of $6,921.58, plus interest at 18.00% from October 9, 2019, on the real property, which has a street address of 3415 Sagamon Avenue, Dayton, OH 45429, being permanent parcel number Parcel No. N64 00407A0040. Plaintiff further alleges that the Tax Certificate(s) be deemed a valid first statutory lien on the Property pursuant to ORC §5721.10 and §5721.35, and otherwise, for the amount owing, together with Plaintiff's advances for demolition and other costs, the amount owing on subsequent tax certificates acquired by Plaintiff concerning the Property, taxes, assessments, and other charges, costs and attorneys' fees; and by reason of a default in payment by Richard Lee Steinway Jr, for amounts due pursuant to the Tax Lien Certificates; Plaintiff alleges such lien(s) are entitled to be foreclosed, that the Court make findings in accordance with ORC §5721.39 (A) and (B), and that unless the amount found due, including Plaintiff's attorneys' fees and costs relating directly or indirectly to the Tax Certificate(s), be tendered to the Plaintiff prior to the filing of an Entry of Confirmation of Sale in this matter, the equity of redemption of all defendants be foreclosed. Plaintiff prays that the Defendant named above be required to answer and assert any interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said Tax Lien Certificates, marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.
