Smith, Savannah Smith, the Unknown Spouse of Stephen E, Smith, and the Unknown Spouse of Savannah Smith you will take notice that on April 25, 2024, Plaintiff, filed a Complaint for foreclosure in the Montgomery County Court of Common Pleas, being Case No. 2024 CV 02412, alleging that there is due to the Plaintiff the sum of $7,060.18, plus interest at 8.150% per annum and at such interest rate as may change from time to time pursuant to the terms of the Note, plus court costs, advances and other charges allowed by the Promissory Note secured by a Mortgage on the real property, which has a street address of 319 Harriet Street Dayton, OH 45417, being permanent parcel number: R72-10609-0023. Plaintiff further alleges that by reason of a default in payment of said Promissory Note, the conditions of said Mortgage have been broken and the same has become absolute. Plaintiff prays that the Defendants named above be required to answer and assert any interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said mortgage, marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.
