Headley whose last known address is 7091 Dayton Springfield Road, Enon, OH 45323 and Unknown Occupants whose last known address is 7091 Dayton Springfield Road, Enon, OH 45323, and who cannot be served, will take notice that on January 31, 2020, Plaintiff, Southwest Stage Funding, LLC dba Cascade Financial Services, filed a Complaint for Money, Foreclosure and other Equitable Relief in the Clark County Court of Common Pleas, Clark County, Ohio, Case No. 20CV0064, against Unknown Spouse of Daniel Headley aka Daniel A. Headley, Unknown Spouses of Unknown Heirs, Legatees of Daniel Headley aka Daniel A. Headley, Unknown Occupants, Dayton Chest Medicine, Inc., Clark County Treasurer, Unknown Creditors and Persons having an interest in the property located at: 7091 Dayton Springfield Road, Enon, OH 45323 and Unknown Heirs, Legatees, Devisees of Daniel Headley aka Daniel A. Headley as Defendants, alleging that, on or about March 13, 2015, Daniel Headley aka Daniel A. Headley, now deceased executed and delivered a Note, in writing, in the original amount of $165,000.00; that Daniel Headley aka Daniel A. Headley, now deceased is in default for all payments from July 1, 2019 until present; that on March 13, 2015, Daniel Headley aka Daniel A. Headley, now deceased, executed and delivered a Mortgage to Southwest Stage Funding, LLC dba Cascade Financial Services, in which said Defendants agreed, among other things, to pay the Note and to comply with all of the terms of the Mortgage hereinafter described, which said Mortgage was recorded on April 20, 2015, at Official Record Book 2053, Page 693, in the office of the Recorder of Clark County; that, further, the balance due on the Note is $161,060.73 with interest at the rate of 4.875% from November 30, 2019; that to secure the payment of the Note, Daniel Headley aka Daniel A. Headley, now deceased executed and delivered the Mortgage, as aforesaid, to Southwest Stage Funding, LLC dba Cascade Financial Services, and thereby conveying, in fee simple, the following described premises: Legal Description Being the same property conveyed by Deed from Charles D. Crace, a married adult to Daniel A. Headley, a married adult on March 12, 2015, recorded in Book 2053, Page 692 on April 20, 2015 in the office of the Clark County Recorder. Parcel No. 1801000006106006 Property address: 7091 Dayton Springfield Road, Enon, OH 45323 Deed Reference: Book 2053 Page 692 Commonly known as 7091 Dayton Springfield Road; Enon, OH 45323 and further alleging that the aforesaid Mortgage is a valid and subsisting first and best lien upon said premises after the lien of the Treasurer; that the Note is in default, whereby the conditions set forth in the Note and Mortgage have been broken, that the Mortgage has become absolute and that the Plaintiff is entitled, therefore, to have the Mortgage foreclosed, the premises sold, and the proceeds applied in payment of Plaintiff's claims; that the Defendants, Unknown Spouse of Daniel Headley aka Daniel A. Headley, Unknown Spouses of Unknown Heirs, Legatees of Daniel Headley aka Daniel A. Headley, Unknown Occupants, Dayton Chest Medicine, Inc., Clark County Treasurer, Unknown Creditors and Persons having an interest in the property located at: 7091 Dayton Springfield Road, Enon, OH 45323 and Unknown Heirs, Legatees, Devisees of Daniel Headley aka Daniel A. Headley, among others, may have or claim to have some interest in or lien upon said premises; that all of the Defendants are required to set forth any claim, lien or interest in or upon the premises that he, she, or it may have or claim to have or be forever barred therefrom; that the Plaintiff demands judgment against the Defendants, Daniel Headley aka Daniel A. Headley, now deceased, in the amount of $161,060.73 with interest at the rate of 4.875% from November 30, 2019, together with its disbursements and advancements for taxes, insurance, and matter related to said premises and its costs herein expended; that the Plaintiff's Mortgage be declared to be a valid and subsisting first and best lien upon said premises after the lien of the Treasurer, if any; that its Mortgage be foreclosed; that all liens be marshalled; that the equity of redemption of all Defendants be forever cut off, barred, and foreclosed; that upon the sale of said premises the proceeds be paid to the Plaintiff to satisfy the amount of its existing lien and the interest, together with its disbursements, advancements, and costs herein expended; and for such other and further relief to which it may be entitled in equity or at law.
