NOTICE Notice of Intent to Declare Forfeiture to: BRYAN M. LLOYD (Lessee), or his heirs, successors and assigns. Please be advised that Clifford S. Wilt and Meta O. Wilt (Lessors), are the current lessors under a certain Oil and Gas Lease, by and between Clifford S. Wilt and Meta O. Wilt, as lessors, and Bryan M. Lloyd, as lessee, dated March 4, 1964, and recorded on March 10, 1964 in Volume 17, Page 97 of the Lease Records in the Office of the Recorder of Clark County, Ohio. The current fee simple owners of the property are Cynthia A. Miller and Terry L. Miller. Lessors' records indicate that Bryan M. Lloyd (Lessee), is the current lessee under an Oil and Gas Lease. Lessee, or his heirs, successors and assigns, is hereby given notice that an Affidavit of Forfeiture regarding said Oil and Gas Lease will be filed pursuant to O.R.C. 5301.332, after thirty days (30) from publication of this notice, unless Lessee, or its successors and assigns, takes prompt action to release or preserve its interest in accordance with Ohio law. The Oil and Gas Lease covers certain real property containing 38.09 acres of land and described as follows: Situate in the Northwest Quarter of Section 13, Town 6, Range 9 M.R.S., Harmony Township, Clark County, Ohio, being part of the 43.07 acre tract conveyed to Kathryn E. Clay by deed recorded in Official Record 630, Page 224 of the Deed Records of Clark County, Ohio and being a tract of land more particularly described as follows: STARTING FOR REFERENCE at a 7" stone found at the northwest corner of said Section 13; Thence from said REFERENCE POINT S 84° 58' 56" E with the north line of said Section 13 a distance of 1299.45 feet to a 6.5" x 2.5" stone found at the northeast corner of the 17.302 acre tract conveyed to Michael Ray Judy and Barbara J. Judy by deed recorded in Official Record 887, Pages 237 and 240 and Official Record 1087, Page 311 and as shown on Survey Record Volume 2, Page 334, of the Clark County Engineer's Record of Land Surveys, said stone being the TRUE POINT OF BEGINNING for the herein described parcel; Thence from said TRUE POINT OF BEGINNING S 84° 58' 56" E continuing with the north line of said Section 13 and the south line of the 77.50 acre tract conveyed to James P. Scofield and Joan M. Scofield by deed recorded in Deed Book 728, Page 364 a distance of 744.81 feet to a 5/8" iron pin set at the northwest corner of the 115.6 acre tract conveyed to Merrill E. Bagent by deed recorded in Deed Book 630, Page 215; Thence S 05° 13' 35" W with the west line of said 115.6 acre tract a distance of 2170.13 feet to a 5/8" iron pin set at the northeast corner of the 2.50 acre tract conveyed to Dustin J. Goodbar and Holly A. Goodbar by deed recorded in Official Record 1583, Page 882; Thence N 84° 46' 49" W with the north line of said 2.50 acre tract a distance of 208.00 feet to a 5/8" iron pin set at the northwest corner of said 2.50 acre tract; Thence S 05° 13' 35" W with the west line of said 2.50 acre tract a distance of 523.56 feet (passing a 5/8" iron pin set at 464.06 feet at the north right-of-way line of South Charleston Pike (State Route 41)) to a MAG nail set in the south line of the Northwest Quarter of said Section 13, at the southwest corner of said 2.50 acre tract, said nail being 0.35' right of centerline station 379+77.71 of O.D.O.T. Right-of-way Plan CLA 41-(2.86)(4.62-4.95), the Centerline Plat of said State Route 41 being recorded in Plat Book 12, Page 30A of the Plat Records of Clark County, Ohio; Thence N 84° 46' 49" W with the south line of the Northeast Quarter of said Section 13 a distance of 150.00 feet to a MAG nail set for a new corner, Thence N 05° 13' 35" E with a new division line through said 43.07 acre tract, parallel with the west line of said 2.50 acre tract, a distance of 618.70 feet (passing a 5/8" iron pin set at 51.96 feet at the north right-of-way line of said State Route 41) to a 5/8" iron pin set for a new corner; Thence N 84° 46' 49" W with a new division line through said 43.07 acre tract, parallel with the south line of the Northwest Quarter of said Section 13, a distance of 388.84 feet to a 5/8" iron pin set for a new corner in the east line of the 102.210 acre tract conveyed to Michael Ray Judy and Barbara J. Judy by deed recorded in Official Record 1087, Page 311 and as shown on Survey Record Volume 2, Page 334; Thence N 05° 16' 58" E with the east line of said 102.210 acre tract and the east line of said 17.302 acre tract a distance of 2072.37 feet to the TRUE POINT OF BEGINNING, containing 38.090 acres of land (including 0.192 acres within the right-of-way of State Route 41), subject to all legal, conditions, easements and rights-of-way pertaining to the premises herein described. This description prepared by Kirk P. Diehl, P.S. #7032, based on a survey made by same in May 2005. All iron pins set are 30" x 5/8" capped "Diehl P.S. 7032". Bearings are based on the north line of Section 13, Town 6, Range 9 M.R.S. being S 84° 58' 56" E as shown on Survey Record Volume 2, Page 334 of the Clark County Engineer's Record of Land Surveys. Parcel No. 130-08-00013-000-015 The Oil and Gas Lease will be declared forfeited and void because the Lessee, its heirs, successors and assigns have abandoned and forfeited the Oil and Gas Lease due to the lack of production and the expiration of the term. There are no producing or drilling oil or gas wells on the leased premises. For the foregoing reasons, Lessors intend to file for record an Affidavit of Forfeiture with the County Recorder if the Oil and Gas Lease is not released of record within thirty (30) days from publication of this notice. 6-6/2019
